Parent Petition

In 2012, Louisiana enacted a parent petition law (La. R.S. 17:10.5), which enables parents to transfer their children’s consistently low-performing school to the Recovery School District. The Recovery School District (RSD) is a statewide school district under the Louisiana Department of Education that works together with charter operators and other educational organizations to transform academically struggling schools into high-performing schools. The Recovery School District currently oversees schools in Orleans, East Baton Rouge, and Caddo parishes.

The parents of students attending Northshore Charter School submitted a petition to be transferred to the Recovery School District which contained at least the minimum number of required signatures.

The LDOE shall accept challenges to the validity of any signature until the close of business, Friday, March 2, 2018. Email to request a copy of the parent petition through a public records request.

To challenge the validity of any signature, the requestor must submit to Megha Upadhyaya (via email at or through a hardcopy request post marked on or before March 2, 2018) the following information in writing:

  1. The name of the parent and student for whom the petition is being challenged;

  2. The reason for the challenge among the acceptable reasons pursuant to Bulletin 129, The Recovery School District and outlined below; and

  3. Evidence to support the challenge.

Pursuant to Bulletin 129, The Recovery School District, acceptable challenges to the validity of a signature shall include, but not be limited to the following:

  1. the student identified in the parent petition was not enrolled in the school on the date of the parent or legal guardian’s signature;

  2. the person signing the petition is not the identified student’s parent or legal guardian;

  3. the signature is a forgery;

  4. the signature was made as a result of harassment, threat, or intimidation; or

  5. the signature was made in exchange for a gift of, or offer to give, directly or indirectly, any money, or anything of apparent present or prospective value.

If validity is challenged or doubted for a number of signatures that, if invalidated, would bring the number of signatures on the parent petition below the majority required, the LDOE shall review and verify the signatures within 45 calendar days.
